Copyright Infringement

NCRYPTO Labs Private Limited ("NCRYPTO" or "the Company") is committed to protecting the intellectual property rights of others, as well as its own proprietary rights. NCRYPTO respects the intellectual property rights of others and expects its users to do the same.
As per the Indian Copyright Act, 1957, any act of infringing copyright is a punishable offense. NCRYPTO has adopted the following policy to respond to notices of alleged copyright infringement that comply with the Indian Copyright Act.
If a copyright owner or their agent believes that their work has been copied in a way that constitutes copyright infringement and is occurring on or through the Company's website or services, they may submit a notification of claimed infringement. The notification must include the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material;
- The requester's contact information, including their address, telephone number, and email address;
- A statement that the requester has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and under penalty of perjury, that the requester is authorized to act on behalf of the copyright owner.
The Company will promptly investigate all notices of alleged copyright infringement and take appropriate actions under the Indian Copyright Act, which may include removing or disabling access to the allegedly infringing material and terminating the accounts of repeat infringers.
If the Company removes or disables access to the allegedly infringing material, the Company will make a good faith attempt to contact the owner or administrator of the affected site or content, so that they may make a counter notification pursuant to the Indian Copyright Act.
If the owner or administrator of the affected site or content believes that their material was removed or disabled by mistake or misidentification, they may submit a counter notification. The counter notification must include the following:
- A physical or electronic signature of the owner or administrator;
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
- A statement under penalty of perjury that the owner or administrator has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
- The requester's contact information, including their address, telephone number, and email address.
If a counter notification is received, the Company may send a copy of the counter notification to the original requester informing that person that it may replace the removed material or cease disabling it in ten (10) business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed material may be replaced or access to it restored in ten (10) to fourteen (14) business days or more after receipt of the counter notification, at the Company's discretion.
NCRYPTO reserves the right to terminate the accounts of users who are repeat infringers of intellectual property rights.
